1. WITHDRAWAL FROM THE CONTRACT

6.1 General information on withdrawal. By withdrawing from the concluded Contract, the Contract is cancelled from the outset. This means that we are mutually obliged to return to each other everything we have provided to one another on the basis of the cancelled Contract, including your delivery costs. The right to withdraw from the Contract may be exercised under the conditions set out in these Terms, or where the legal regulations so provide.

6.2 Consumer's statutory right. If you are a consumer, you have the right to withdraw from the concluded Contract within a period of 14 days, namely:

6.2.1 from the day of receipt of the Goods,

6.2.2 in the case of a Contract whose subject matter is several types of Goods or the delivery of several parts, from the day of receipt of the last delivery of the Goods,

6.2.3 in the case of a Contract whose subject matter is the regular, repeated delivery of Goods, from the day of receipt of the first delivery of the Goods;

however, only where it is not a special case in which withdrawal is excluded (see clause 6.5 below).

6.3 Consumer's contractual right to withdraw from the Contract. If you are a consumer, you additionally have, beyond the law, the right to withdraw from the concluded Contract even earlier, at any time from the day of conclusion of the Contract until the day of dispatch of the Goods, of which we will inform you.

6.4 Our right to withdraw from the Contract. We have the right to withdraw from the concluded Contract at any time up to the moment of dispatch of the Goods. Before withdrawing, we will always contact you in order to agree on how to proceed and to state the reasons that led us to take this step.

6.5 Impossibility of withdrawal from the Contract. You do not have the statutory right to withdraw from the Contract in particular for Contracts:

6.5.1 for the supply of foodstuffs, beverages or other goods of everyday consumption delivered to the consumer's household or to another place designated by the consumer,

6.5.2 concluded using vending machines or automated commercial premises,

6.5.3 for the supply of Goods that are an alcoholic beverage which may only be delivered after 30 days have elapsed and whose price depends on fluctuations of the financial market beyond our control;

6.5.4 for the supply of Goods that have been adapted according to your wishes or for your person (e.g. engraving of a bottle, etc.),

6.5.5 for the supply of Goods in a sealed package that have been taken out of the package and which, for reasons of hygiene, cannot be returned,

6.5.6 for the supply of Goods that are perishable, as well as Goods that, after delivery, have been irreversibly mixed with other goods,

6.5.7 for the supply of Goods whose price depends on fluctuations of the financial market beyond our control and which may occur during the period for withdrawal from the Contract,

6.5.8 and others, where a legal regulation so provides.

6.6 Manner of withdrawal from the Contract. If the right to withdraw from the Contract has arisen for you and you actually wish to withdraw from the Contract, you may do so by means of a unilateral legal act which you deliver to us, preferably by completing the model withdrawal form, which is located on the Portal at the address, and sending it

6.6.1 by e-mail to the e-mail address info@spinkids.ie; or

6.6.2 in writing to the address of our Premises.

When withdrawing, we recommend stating in particular the Order number, the specification of the Goods in respect of which you are withdrawing, the date of purchase and the date of delivery, and presenting the original or a copy of the proof of purchase of the Goods. Consignments from which it is not apparent why they have been sent to us will be returned to the sender without further action.

6.7 Observance of the period. If you are a consumer, in order to comply with the period for withdrawal from the Contract, it is sufficient that you send us the withdrawal on the last day of the period set for withdrawal from the Contract.

6.8 Return of the Goods after withdrawal from the Contract. If you withdraw from the Contract, you are obliged to return the Goods to us at your own expense, preferably together with the withdrawal from the Contract, at the latest within 14 days of delivery of the withdrawal, preferably by sending the Goods to the address of our Premises.

6.9 Condition of the Goods upon return. You must return the Goods to us undamaged, unsoiled, unworn and showing no signs of use, including all accessories and documentation, if possible in the original packaging (please note that if the original packaging intended to ensure the hygienic properties of the Goods is breached, it is not possible to withdraw from the contract for the supply of such goods pursuant to clause 6.5 above). At the same time, you are obliged to return to us also all gifts and bonuses that you received from us on the basis of the Contract in connection with the purchase of the Goods.

6.10 Refund of funds after withdrawal from the Contract. If, as a consumer, you withdraw from the Contract, we will refund the amounts paid within 14 days of delivery of the withdrawal from the Contract, but no earlier than once you return the Goods to us or prove that the Goods have been dispatched to us. We will refund the paid delivery costs of the Goods only in the amount corresponding to the cheapest comparable delivery method we offer. If the value of the returned Goods is reduced as a result of handling other than what is necessary to become acquainted with their nature, characteristics and functionality, the refunded amount will be reduced by the amount by which the value of the Goods has decreased. We will refund the funds to you in the same way in which we received them from you, or in another way that we agree, provided that this does not incur additional costs for you.
